Trademark Process

USPTO Trademark Registration Process

Step 1Is a Trademark the right fit?

Trademarks protect brand names and logos by distinguishing the source of the goods or services offered. Patents protect inventions and a copyright protects creative literary or artistic work that is original. You can learn more about each here.

Step 2Prepare Your Application

Select your mark and conduct searches. You will need to assess the strength of your desired mark and the likelihood of success for registration. Throughout the process be aware of trademark scams and contact Idora Law Studio regarding suspect activity related to your application.

Step 3Submit Your Application

Work with Idora Law Studio to finalize your application information. Your application will be submitted through the USPTO online filing platform. Pay associated fees. Filing fees are not refundable even if your application is not successful.

Step 4Address any Issues with the USPTO

After an initial review, the USPTO will assign your application a serial number and forward the application to an examining attorney. This process can take several months. If the examining attorney determines that there are deficiencies with your application, they will issue an “office action” and explain the reasons for refusal. It is very important to work with Idora Law Studio to ensure that your response is timely and thoroughly addresses any issues raised by the USPTO.
